56 NC’s original voter ID law, HB589 (SL2013-381) included a loophole that suspended the new voter ID requirements for anybody voting from their car. After discovering this “curbside exception,” I set about to learn its rationale. Every lawmaker I asked about it did not realize it was in the law, nor did Tom Farr, the drafter of the original omnibus bill. Finally, when I asked Rep David Lewis, neither he nor his Chief of Staff, Greg Gebhardt, expressed any surprise at all. Instead, Greg volunteered, “we can’t let the media accuse us of going after old people.” It wasn’t the last time Greg would play the media-fear card.

112 Just for fun, I later met with his replacement, Dennis Duffy, and handed him a CD with all of our evidence to prove that 149 people had voted in both Florida and North Carolina during 2012’s November election. The interstate angle gave the case federal jurisdiction, so Duffy went through the theatrics of pretending it was important and that he would look into it. And yes… he said he would send it to the Public Integrity Section at FBI Headquarters. I knew it was a waste of time, but did it anyway. We closed with this warning from him, “We will not be able to give you any updates on the status of these cases… ever.”

124 North Carolina is a one-party consent state when it comes to recording conversations, meaning that it’s legal, provided at least one person being recorded knows they’re being recorded. I didn’t inform her of the recording, but now advise getting their permission up-front and on the record. If they say, “no,” then you don’t have to do the interview! By having your own copy of the recording, it also motivates the reporter not to put words in your mouth. It’s your very best insurance when doing media interviews.
