In 2018, NBC news found Chinese components in the type of ES&S voting machines used in NC. Your passing of election reform bills is a nice gesture, but . . .

  • Before you “fix” the process, why not learn how badly it’s broken?

  • Current NC law audits only the Presidential contest and no others?

  • Did you miss NBC finding Chinese components in ES&S machines?

  • How can we trust election administrators to audit their own work?

  • How will you restore public trust in the integrity of our elections?

  • When will you assert the Legislature’s election oversight authority?

  • Who is afraid of what a NH- or AZ-style audit of 2020 might reveal?

Whereas, the US Department of Homeland Security conducted a forensic audit on VR Systems, the vendor responsible for 2016’s Durham County electronic poll book “glitches” that enabled Durham to become the last county reporting election results that year;

And whereas, the Durham County results included 94,000 votes that decisively flipped the outcome of 2016’s races for Governor, Attorney General, and State Auditor, the only statewide offices constitutionally endowed with subpoena power;

And whereas, NBC News reported in 2018 that ES&S, the largest election equipment vendor operating in North Carolina, includes components imported from the People’s Republic of China;

And whereas, in the same report, ES&S denied any major components were imported without ever proving, under penalty of perjury, which parts were of Chinese origin and the function of said parts;

And whereas, evidence brought forward in a Michigan legal proceeding included evidence of a heretofore unknown modem embedded in the ES&S DS200 machine, making possible the outside manipulation of vote tallies in real time;

And whereas, the ES&S DS 200 is widely used in most North Carolina jurisdictions;

And whereas, in time for the 2020 elections, NC State Board of Elections Executive Director Karen Bell circumvented the spirit and intent of the law by unilaterally banning the time-honored signature-verification procedures that is critical to preventing and detecting enterprise-level absentee ballot fraud;

And whereas, a post-election Monmouth University poll found that only 44% of Americans were “very confident” that our elections were conducted fairly and accurately and 76% of Republicans were “not confident” in the fairness and accuracy of the 2020 election;

And whereas, in a February 2020 Gallup World Poll, the U.S. fell to third from the bottom, just ahead of Chile and Mexico, among 32 countries, when it came to trust in elections;

And whereas, NC 2020 electoral practices encouraged absentee fraud similar to Aberdeen, Mississippi’s, where 78% of all mail-in absentee ballots were proven fraudulent and a new election was ordered;

And whereas, legislative branches in Arizona and New Hampshire have enacted and implemented decisive measures to reassert their constitutional authority over the electoral process;

And whereas, the North Carolina General Assembly has both the duty and the constitutional authority to audit the results from any and all elections;

Therefore: Be it resolved, before the conclusion of the 2021 “long session,” the NCGA will mandate and fund a bipartisan and public audit of the 2020 general election in this manner:

  1. Conduct a bipartisan, hand-eye, public recount of every contest on the ballot in three counties for each of the three tabulation machines certified for use in the 2020 general election (for a total of nine audits);
  2. Result discrepancies between the machine and the hand-eye recount > 0.1% will trigger at least two independent forensic audit teams to determine the root cause.
  3. Investigate the ownership and the component origins of all ES&S machinery certified for use in NC.
  4. Conduct a bipartisan signature analysis of all absentee ballot envelopes compared with voter registration signatures in the seven counties casting the most absentee by-mail votes and in all nursing homes that refused the help of a Multi-partisan Assistance Team during the 2020 general election.
  5. Obtain a full accounting of all state, federal, and private funds received and spent by the NCSBE during 2020 and of all electoral fraud complaints that have been referred for prosecution since 2014.

Audit North Carolina's 2020 Elections

Dear Speaker Moore and Senator Berger,

The North Carolina Constitution gives exclusive control of our electoral process to your branch of government. While you have delegated much of that authority to a state agency controlled by the Governor, the courts have regularly affirmed that state legislatures hold the ultimate authority.
Among those delegated duties, you've endowed the NC State Board of Elections with the work of investigating electoral irregularities. Just as Wall Street firms would have a conflict when investigating securities fraud, election administrators have a similar credibility problem.
As you know, state law currently requires only a random audit of the most recent Presidential election, so nobody is auditing any of the down-ballot races. Add to this weakness, the very real concerns over tabulation machine fraud and the Chinese components within the vast majority of election equipment currently used all across North Carolina. Is it any wonder that a growing number of voters have doubts about the integrity of our most recent general election?
While that's bad news, YOU and you alone have the authority to change this spiraling public trust of our most sacred civic duty. And since this is an oversight function, you do not need the Governor's permission to reassert your constitutional authority.
So, before you blindly enact more laws to "solve" the problems from 2020, we demand that you conduct a top-to-bottom audit of our elections before the end of this year's "long" session. At a minimum, this audit should include these actions:

  1. Conduct a bipartisan, hand-eye, public recount of every contest on the ballot in three counties for each of the three tabulation machines certified for use in the 2020 general election (for a total of nine audits);
  2. Any result discrepancies between the machine and the hand-eye recount > 0.01% will trigger at least two independent forensic audit teams to determine the root cause.
  3. Hold hearings that investigate the ownership and the component origins of all ES&S machinery certified for use in NC.
  4. Conduct a bipartisan signature analysis of all absentee ballot envelopes compared with voter registration signatures in the seven counties casting the most absentee by-mail votes and in all nursing homes that refused the help of a Multi-partisan Assistance Team during the 2020 general election.
